ANYONE FROM NY? NEED HELP? -

Can someone please let me know what a landlord has to do to get someone evicted? I myself am not being evicted but my friend is. Does the landlord have to hire a lawyer or can they just do it through small claims court? She is paying her rent and has all along, however she had a falling out with landlord and now the landlord wants her out. Her lease is also up and is on a month to month. I know that technically the landlord can tell her to get out because there is no longer a lease, but what channels must the landlord go through?

In NYC, a landlord can terminate a month to month agreement with 30 days notice.http://www.housingnyc.com/html/resourcesAs for eviction, one thing that will make a difference is whether the apartment is rent-regulated or stabilized. If so, complications come into play but assuming it s not the landlord can bring a suit requesting a summary judgment for holdover. It s relatively routine, the landlord wouldn t necessarily need a lawyer to do so though most do use one.More information on eviction procedure:http://www.housingnyc.com/html/resources
